Omaha Domestic Violence

Domestic Violence Protection Order:

Nebraska law offers two specific and varying protection orders: the domestic abuse protection order and the harassment protection order. The domestic abuse protection order is available only to specific individuals who fall within the intimate partner classification. The term “intimate partner” refers to:

  • Present or former spouse
  • Parents of the same child
  • Couple in an intimate dating relationship

If you are served with a domestic abuse protection order, the applicant will be granted specific rights and you will be prohibited from engaging in various behaviors for up to 90 days. Other sanctions may be ordered, as well:

  • Physical violence is strictly prohibited, including:
  • Threats,
  • Attacks,
  • Assaults

  • Do not disturb the peace of the petitioner
  • Do not contact by phone, email or other means
  • Child custody may be given to petitioner for up to 90 days
  • Other court sanctions and prohibitions may be ordered

As a respondent, you are advised to quickly obtain legal representation from a qualified and experienced Omaha protection order attorney. Depending on the circumstances of your case, it may be wise to challenge the protection order in court. At the hearing you will be provided with an opportunity to offer evidence in support of your position. It is the job of your Omaha protection order attorney to present your case convincingly and effectively. A challenge may or may not result in modifications to the order; however, it is certain that if you do not challenge it, you will be required to adhere to it as it is.
